Terms of Use

<p>This is an English translation of the Korean Terms of Use, provided for reference. The Korean text is based on the Korea Fair Trade Commission's Standard Terms for Electronic Commerce (Internet Cyber Malls), Standard Terms No. 10023, revised June 26, 2015. If the two versions differ, the Korean version prevails.</p><h2>Article 1 (Purpose)</h2><p>These Terms set out the rights, obligations and responsibilities of the cyber mall and its users in using the internet-related services (the "Services") provided by the Arte MUSE cyber mall (the "Mall") operated by LTWO LEATHER GOODS (the e-commerce business operator).</p><p>※ These Terms also apply, to the extent their nature allows, to electronic commerce conducted through PC communications, wireless networks and similar means.</p><h2>Article 2 (Definitions)</h2><p>① "Mall" means the virtual place of business that LTWO LEATHER GOODS has set up, using computers and other information and communications equipment, so that goods or services ("Goods") can be traded with users. It also refers to the business operator that runs the cyber mall.</p><p>② "User" means a member or non-member who accesses the Mall and receives the Services the Mall provides under these Terms.</p><p>③ "Member" means a person who has registered as a member of the Mall and may continue to use the Services the Mall provides.</p><p>④ "Non-member" means a person who uses the Services the Mall provides without registering as a member.</p><h2>Article 3 (Posting, Explanation and Amendment of the Terms)</h2><p>① The Mall posts these Terms, together with its trade name and the name of its representative, the address of its place of business (including the address where consumer complaints can be handled), its telephone number, fax number and e-mail address, its business registration number, its mail-order business registration number and its personal information manager, on the first service screen (front page) of the Arte MUSE cyber mall so that users can easily find them. The content of the Terms may, however, be made available through a linked screen.</p><p>② Before a user agrees to the Terms, the Mall must provide a separate linked screen or pop-up screen and obtain the user's confirmation, so that the user can understand the important provisions of the Terms, such as withdrawal of an order, responsibility for delivery and conditions for refunds.</p><p>③ The Mall may amend these Terms to the extent that doing so does not violate the relevant laws, including the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-Door Sales, and the Framework Act on Consumers.</p><p>④ When the Mall amends the Terms, it states the effective date and the reason for the amendment and gives notice on the Mall's first screen, together with the current Terms, from seven days before the effective date until the day before the effective date. If the amendment is unfavorable to users, the Mall gives notice with a grace period of at least thirty days. In that case the Mall clearly compares the content before and after the amendment and presents it so that users can easily understand it.</p><p>⑤ When the Mall amends the Terms, the amended Terms apply only to contracts concluded after the effective date. The provisions of the Terms before the amendment continue to apply to contracts already concluded before that date. However, if a user who has already concluded a contract wishes to be subject to the amended Terms and notifies the Mall of this within the notice period for the amended Terms under paragraph ③, and the Mall consents, the amended Terms apply.</p><p>⑥ Matters not set out in these Terms and the interpretation of these Terms are governed by the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Guidelines for Consumer Protection in Electronic Commerce set by the Korea Fair Trade Commission, and related laws or commercial practice.</p><h2>Article 4 (Provision and Change of Services)</h2><p>① The Mall carries out the following business.</p><ol><li>Providing information on goods or services and concluding purchase contracts</li><li>Delivering goods or services for which a purchase contract has been concluded</li><li>Other business determined by the Mall</li></ol><p>② If goods or services are sold out or their technical specifications change, the Mall may change the content of the goods or services to be provided under contracts concluded in the future. In that case the Mall states the changed content of the goods or services and the date of provision and gives immediate notice in the place where the current content of the goods or services is posted.</p><p>③ If the Mall changes the content of a Service it has contracted with a user to provide, because the Goods are sold out, their technical specifications have changed or for a similar reason, it immediately notifies the user of the reason at an address where the user can be reached.</p><p>④ In the case of the preceding paragraph, the Mall compensates the user for damage the user suffers as a result. This does not apply if the Mall proves that it acted without intent or negligence.</p><h2>Article 5 (Suspension of Services)</h2><p>① The Mall may temporarily suspend the provision of the Services in the event of maintenance, inspection, replacement or breakdown of computers or other information and communications equipment, an interruption of communications or a similar cause.</p><p>② The Mall compensates users or third parties for damage they suffer because the provision of the Services is temporarily suspended for a cause under paragraph ①. This does not apply if the Mall proves that it acted without intent or negligence.</p><p>③ If the Mall can no longer provide the Services because of a change in its line of business, abandonment of the business, a merger between companies or a similar reason, the Mall notifies users in the manner set out in Article 8 and compensates consumers according to the conditions the Mall originally presented. If the Mall has not given notice of compensation standards, it pays users the value of their mileage, reserve points or the like in kind or in cash, corresponding to the currency value used in the Mall.</p><h2>Article 6 (Membership Registration)</h2><p>① A user applies for membership by entering member information in the registration form set by the Mall and indicating agreement to these Terms.</p><p>② The Mall registers as a member any user who has applied for membership as in paragraph ①, unless one of the following applies.</p><ol><li>The applicant has previously lost membership under Article 7 paragraph ③ of these Terms. An exception applies to a person for whom three years have passed since losing membership under Article 7 paragraph ③ and who has obtained the Mall's consent to re-register.</li><li>The registration details contain false information, omissions or errors.</li><li>The Mall judges that registering the applicant as a member would cause significant technical difficulties for the Mall.</li></ol><p>③ The membership contract is formed when the Mall's acceptance reaches the member.</p><p>④ If there is a change to the details registered at the time of joining, the member must inform the Mall of the change within a reasonable period, by editing the member information or by a similar method.</p><h2>Article 7 (Withdrawal from and Loss of Membership)</h2><p>① A member may ask the Mall to cancel the membership at any time, and the Mall processes the cancellation immediately.</p><p>② If a member falls under any of the following, the Mall may restrict or suspend the membership.</p><ol><li>The member registered false information when applying for membership.</li><li>The member does not pay, by the due date, the price of Goods purchased through the Mall or another debt the member owes in connection with the use of the Mall.</li><li>The member threatens the order of electronic commerce, for example by interfering with another person's use of the Mall or stealing that person's information.</li><li>The member uses the Mall to do something that is prohibited by law or by these Terms or that is contrary to public order and morals.</li></ol><p>③ If, after the Mall has restricted or suspended a membership, the same conduct is repeated two or more times or the cause is not corrected within thirty days, the Mall may terminate the membership.</p><p>④ When the Mall terminates a membership, it cancels the member registration. In that case the Mall notifies the member and, before cancelling the registration, gives the member an opportunity to explain, setting a period of at least thirty days.</p><h2>Article 8 (Notices to Members)</h2><p>① When the Mall gives notice to a member, it may do so at the e-mail address the member has designated by prior arrangement with the Mall.</p><p>② For notices to an unspecified large number of members, the Mall may substitute individual notice by posting the notice on the Mall's bulletin board for at least one week. However, the Mall gives individual notice of matters that have a significant effect on a member's own transactions.</p><h2>Article 9 (Purchase Applications and Consent to the Provision of Personal Information)</h2><p>① A user of the Mall applies for a purchase on the Mall by the following or a similar method, and the Mall must present each of the following items in a way that is easy to understand when the user applies.</p><ol><li>Searching for and selecting Goods</li><li>Entering the recipient's name, address, telephone number, e-mail address (or mobile phone number) and the like</li><li>Confirming the content of the Terms, the services for which the right to withdraw an order is restricted, and the costs to be borne, such as delivery and installation charges</li><li>Indicating agreement to these Terms and confirmation or refusal of the matters in item 3 (for example, by a mouse click)</li><li>Applying to purchase the Goods and confirming this, or agreeing to the Mall's confirmation</li><li>Selecting a payment method</li></ol><p>② If the Mall needs to provide a purchaser's personal information to a third party, it must inform the purchaser of 1) the recipient of the personal information, 2) the recipient's purpose in using the personal information, 3) the items of personal information to be provided and 4) the period for which the recipient will retain and use the personal information, and obtain the purchaser's consent. (The same applies when a matter that has been consented to changes.)</p><p>③ If the Mall entrusts a third party with work that involves handling a purchaser's personal information, it must inform the purchaser of 1) the party entrusted with handling the personal information and 2) the content of the entrusted work, and obtain the purchaser's consent. (The same applies when a matter that has been consented to changes.) However, where this is necessary to perform a contract for the provision of services and relates to the purchaser's convenience, the Mall need not go through the notification and consent procedures if it gives notice through its personal information handling policy in the manner prescribed by the Act on Promotion of Information and Communications Network Utilization and Information Protection.</p><h2>Article 10 (Formation of the Contract)</h2><p>① The Mall may decline a purchase application under Article 9 if any of the following applies. When concluding a contract with a minor, the Mall must give notice that the minor or the minor's legal representative may cancel the contract if the consent of the legal representative has not been obtained.</p><ol><li>The application contains false information, omissions or errors.</li><li>A minor purchases goods or services prohibited by the Juvenile Protection Act, such as tobacco or alcohol.</li><li>The Mall judges that accepting the purchase application would cause significant technical difficulties for the Mall.</li></ol><p>② The contract is deemed to be formed when the Mall's acceptance reaches the user in the form of the acknowledgement of receipt under Article 12 paragraph ①.</p><p>③ The Mall's expression of acceptance must include confirmation of the user's purchase application, whether the Goods are available for sale, and information on correcting or cancelling the purchase application.</p><h2>Article 11 (Payment Methods)</h2><p>Payment for goods or services purchased on the Mall may be made by any of the following methods that is available. The Mall may not add any fee, under any name, to the price of the Goods on account of the user's payment method.</p><ol><li>Account transfers of all kinds, such as phone banking, internet banking and mail banking</li><li>Card payments of all kinds, such as prepaid cards, debit cards and credit cards</li><li>Online deposit without a bankbook</li><li>Payment by electronic money</li><li>Payment on receipt</li><li>Payment with points granted by the Mall, such as mileage</li><li>Payment with gift certificates that the Mall has contracted for or recognizes</li><li>Payment by other electronic means</li></ol><h2>Article 12 (Acknowledgement of Receipt, and Change and Cancellation of Purchase Applications)</h2><p>① When a user applies for a purchase, the Mall sends the user an acknowledgement of receipt.</p><p>② A user who has received the acknowledgement of receipt may, if there is a discrepancy in the expression of intent or the like, ask to change or cancel the purchase application immediately after receiving it. If the user makes the request before delivery, the Mall must process it without delay. If payment has already been made, the provisions on withdrawal of an order in Article 15 apply.</p><h2>Article 13 (Supply of Goods)</h2><p>① Unless the Mall and the user have separately agreed on the time of supply, the Mall takes the necessary steps, such as made-to-order production and packaging, so that the Goods can be shipped within seven days from the date of the user's order. If the Mall has already received all or part of the price of the Goods, it takes those steps within three business days from the date it received all or part of the price. The Mall takes appropriate measures so that the user can check the supply procedure and progress of the Goods.</p><p>② For goods a user has purchased, the Mall states the means of delivery, who bears the delivery cost for each means, and the delivery period for each means. If the Mall exceeds the agreed delivery period, it must compensate the user for the resulting damage. This does not apply if the Mall proves that it acted without intent or negligence.</p><h2>Article 14 (Refunds)</h2><p>If the Mall cannot deliver or provide the Goods a user has applied to purchase because they are sold out or for a similar reason, it notifies the user of the reason without delay. If it has received payment for the Goods in advance, it refunds the payment, or takes the steps necessary for a refund, within three business days from the date it received the payment.</p><h2>Article 15 (Withdrawal of an Order)</h2><p>① A user who has concluded a contract with the Mall for the purchase of Goods may withdraw the order within seven days from the date of receiving the written statement of the contract under Article 13 paragraph 2 of the Act on the Consumer Protection in Electronic Commerce (or, if the Goods were supplied later than the written statement was received, from the date the Goods were supplied or their supply began). If the Act on the Consumer Protection in Electronic Commerce provides otherwise regarding withdrawal of an order, the provisions of that Act apply.</p><p>② A user who has received the Goods may not return or exchange them in any of the following cases.</p><ol><li>The Goods have been lost or damaged for a reason attributable to the user. (The user may still withdraw the order if the packaging was damaged in order to check the contents of the Goods.)</li><li>The value of the Goods has decreased significantly because of the user's use or partial consumption.</li><li>The value of the Goods has decreased with the passage of time to the extent that resale is difficult.</li><li>Where the Goods can be reproduced as goods of the same performance, the packaging of the original Goods has been damaged.</li></ol><p>③ In the cases of items 2 to 4 of paragraph ②, the user's right to withdraw the order is not restricted if the Mall did not, in advance, clearly state the restriction in a place where the consumer could easily see it or take a measure such as providing a trial product.</p><p>④ Notwithstanding paragraphs ① and ②, if the content of the Goods differs from what was displayed or advertised, or the contract was performed differently from its terms, the user may withdraw the order within three months from the date the Goods were supplied, or within thirty days from the date the user knew or could have known of that fact.</p><h2>Article 16 (Effects of Withdrawal of an Order)</h2><p>① When the Mall has received returned Goods from a user, it refunds the price already paid for the Goods within three business days. If the Mall delays the refund, it pays interest for the period of delay, calculated at the rate of interest for delay prescribed in Article 21-2 of the Enforcement Decree of the Act on the Consumer Protection in Electronic Commerce.</p><p>② In refunding the price, if the user paid for the Goods by credit card, electronic money or a similar means of payment, the Mall asks the business operator that provided the means of payment, without delay, to suspend or cancel the charge for the price of the Goods.</p><p>③ When an order is withdrawn, the user bears the cost of returning the Goods supplied. The Mall does not claim a penalty or damages from the user on the ground of the withdrawal. However, if the order is withdrawn because the content of the Goods differs from what was displayed or advertised, or the contract was performed differently from its terms, the Mall bears the cost of returning the Goods.</p><p>④ If the user bore the shipping cost when the Goods were provided, the Mall clearly indicates, in a way the user can easily understand, who bears that cost when the order is withdrawn.</p><h2>Article 17 (Protection of Personal Information)</h2><p>① When collecting users' personal information, the Mall collects the minimum personal information necessary to provide the Services.</p><p>② The Mall does not collect in advance, at the time of membership registration, information needed to perform a purchase contract. This does not apply where identity verification is required before a purchase contract in order to fulfil an obligation under the relevant laws and the Mall collects the minimum specific personal information for that purpose.</p><p>③ When the Mall collects and uses a user's personal information, it informs the user of the purpose and obtains the user's consent.</p><p>④ The Mall may not use the personal information it has collected for any purpose other than the stated purpose. If a new purpose of use arises or the information is to be provided to a third party, the Mall informs the user of the purpose and obtains consent at the stage of use or provision. An exception applies where the relevant laws provide otherwise.</p><p>⑤ Where the Mall must obtain the user's consent under paragraphs ② and ③, it must state or give notice in advance of the matters prescribed in Article 22 paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, such as the identity of the personal information manager (affiliation, name, telephone number and other contact details), the purposes of collecting and using the information, and matters relating to the provision of information to third parties (the recipient, the purpose of provision and the content of the information to be provided). The user may withdraw this consent at any time.</p><p>⑥ A user may at any time ask to view, and to have errors corrected in, the user's own personal information held by the Mall, and the Mall is obliged to take the necessary measures without delay. If a user has asked for an error to be corrected, the Mall does not use that personal information until the error has been corrected.</p><p>⑦ To protect personal information, the Mall must limit to a minimum the number of persons who handle users' personal information, and it bears full responsibility for damage to users caused by the loss, theft, leakage, provision to a third party without consent, or alteration of users' personal information, including credit card and bank account information.</p><p>⑧ The Mall, or a third party that has received personal information from it, destroys the personal information without delay once the purpose for which it was collected or received has been achieved.</p><p>⑨ The Mall does not set the consent box for the collection, use or provision of personal information as selected in advance. The Mall also states specifically which services are restricted if a user refuses consent to the collection, use or provision of personal information, and does not restrict or refuse the provision of services, such as membership registration, on the ground that a user has refused consent to the collection, use or provision of personal information that is not a required item.</p><h2>Article 18 (Obligations of the Mall)</h2><p>① The Mall does not do anything that is prohibited by law or by these Terms or that is contrary to public order and morals, and must do its best to provide goods and services continuously and stably as set out in these Terms.</p><p>② The Mall must have a security system in place to protect users' personal information (including credit information) so that users can use the internet service safely.</p><p>③ If a user suffers damage because the Mall has engaged in unfair labeling or advertising, as defined in Article 3 of the Act on Fair Labeling and Advertising, in relation to goods or services, the Mall is liable to compensate for the damage.</p><p>④ The Mall does not send commercial advertising e-mail that users do not want.</p><h2>Article 19 (Members' Obligations Regarding IDs and Passwords)</h2><p>① Except in the case of Article 17, the member is responsible for managing the member's ID and password.</p><p>② A member must not let a third party use the member's ID and password.</p><p>③ If a member becomes aware that the member's ID and password have been stolen or are being used by a third party, the member must notify the Mall immediately and follow the Mall's guidance, if any.</p><h2>Article 20 (Obligations of Users)</h2><p>Users must not do any of the following.</p><ol><li>Registering false information when applying or making changes</li><li>Stealing another person's information</li><li>Altering information posted on the Mall</li><li>Transmitting or posting information (such as computer programs) other than the information specified by the Mall</li><li>Infringing the copyright or other intellectual property rights of the Mall or of a third party</li><li>Damaging the reputation of the Mall or of a third party, or interfering with their business</li><li>Disclosing or posting on the Mall obscene or violent messages, images or sounds, or other information contrary to public order and morals</li></ol><h2>Article 21 (Relationship Between a Linking Mall and a Linked Mall)</h2><p>① Where an upper-level mall and a lower-level mall are connected by a hyperlink (the object of a hyperlink includes text, pictures and moving images) or a similar method, the former is called the linking mall (website) and the latter the linked mall (website).</p><p>② If the linking mall has stated, on its first screen or in a pop-up screen at the point of connection, that it does not guarantee transactions carried out with users in relation to Goods independently provided by the linked mall, it bears no guarantee liability for those transactions.</p><h2>Article 22 (Ownership of Copyright and Restrictions on Use)</h2><p>① Copyright and other intellectual property rights in works created by the Mall belong to the Mall.</p><p>② Users must not use, for commercial purposes, information obtained by using the Mall in which the intellectual property rights belong to the Mall, or allow a third party to use it, by reproduction, transmission, publication, distribution, broadcasting or any other method, without the Mall's prior consent.</p><p>③ When the Mall uses a copyright that belongs to a user under an agreement, it must notify that user.</p><h2>Article 23 (Dispute Resolution)</h2><p>① The Mall establishes and operates a body for handling compensation, in order to reflect legitimate opinions and complaints raised by users and to compensate for their damage.</p><p>② The Mall gives priority to handling complaints and opinions submitted by users. If prompt handling is difficult, the Mall immediately notifies the user of the reason and the schedule for handling.</p><p>③ If a user applies for relief from damage in connection with an electronic commerce dispute between the Mall and the user, the matter may be referred to mediation by a dispute mediation body commissioned by the Korea Fair Trade Commission or by a mayor or provincial governor.</p><h2>Article 24 (Jurisdiction and Governing Law)</h2><p>① A lawsuit concerning an electronic commerce dispute between the Mall and a user falls under the exclusive jurisdiction of the district court for the user's address at the time the lawsuit is filed or, if there is no address, the user's place of residence. If the user's address or place of residence at the time of filing is unclear, or the user resides abroad, the lawsuit is filed with the competent court under the Civil Procedure Act.</p><p>② Korean law applies to electronic commerce lawsuits filed between the Mall and a user.</p><h2>Addendum</h2><p>These Terms take effect on October 7, 2026.</p>
